These Terms and Conditions (referred to as the “Agreement” or “Terms”) set forth the rules and guidelines for accessing and using Heartllink (the “Website”), unless otherwise specified in separate terms applicable to particular services. The Website, including all related features and services (the “Service”), is owned and managed by the entity identified within these Terms.
We strongly recommend reviewing this Agreement together with our Privacy Policy, Cookie Policy, Pricing & Refund Policy, Community Standards, Compliance Policies, and Online Dispute Resolution section below, as well as any other Supplemental Terms presented for a specific feature. These documents clarify your rights and responsibilities as a user.

PLEASE NOTE THAT THESE TERMS INCLUDE A MANDATORY ARBITRATION CLAUSE, WHICH REQUIRES DISPUTES TO BE RESOLVED THROUGH ARBITRATION ON AN INDIVIDUAL BASIS. THIS MEANS LIMITED APPEAL RIGHTS, AND THE CASE WILL NOT BE REVIEWED BY A JUDGE AS IT WOULD IN COURT. SECTION 15 GOVERNS YOUR RIGHTS UNDER THIS AGREEMENT FOR ALL SERVICES, TO THE EXTENT SUCH PROVISIONS ARE PERMITTED BY APPLICABLE LAW.
THESE TERMS ALSO INCLUDE A CLASS ACTION WAIVER, DISCLAIMERS OF WARRANTIES, AND LIMITATIONS OF LIABILITY, SUBJECT TO APPLICABLE LAW.
2. ACCEPTANCE OF TERMS
Agreement Overview
These Terms establish a legally binding agreement between you and AVENIQ DIGITAL LTD, a private limited company incorporated in Cyprus under registration number HE 494971, with its registered office at:

Supplemental Terms
Certain features or sections of the Service may have specific terms and conditions (“Supplemental Terms”), which will either be included in this Agreement or presented separately, such as through FAQs, Community Guidelines, or similar policies. Unless explicitly stated otherwise, all Supplemental Terms form an integral part of this Agreement.
Definition of Users
For the purposes of this Agreement, any individual accessing or interacting with the Website, whether registered or not, is considered a “User.”
Minimum Age Requirement

Compliance with Laws
You are responsible for ensuring that your use of the Website and Services complies with applicable laws in your jurisdiction. By accessing the Website, you confirm that you have the legal capacity to enter into this Agreement and that you adhere to all applicable legal and contractual obligations. Providing false or misleading information may result in immediate account termination, subject to applicable law.
3. WEBSITE USAGE
Account Registration
To access the Website’s features and services, you must create a free account. Registration requires providing details such as your email, name, nickname, password, gender, and date of birth. Alternatively, you may register using your Google account.
Access, registration, and paid transactions are not available from the following restricted countries and territories (the “Restricted Jurisdictions”): Abkhazia, Afghanistan, Algeria, Angola, Bahrain, Bangladesh, Barbados, Belarus, Botswana, Bulgaria, Burkina Faso, Burundi, Cameroon, Cape Verde, Cayman Islands, Central African Republic, Chad, China, Crimea, Côte d'Ivoire, Cuba, Democratic Republic of the Congo, Djibouti, Donetsk region, Egypt, Ethiopia, Gambia, Ghana, Gibraltar, Haiti, Hong Kong, Hungary, Iran, Iraq, Jamaica, Jordan, Kazakhstan, Kuwait, Lebanon, Liberia, Libya, Luhansk region, Mali, Moldova, Morocco, Mozambique, Myanmar, Namibia, Nepal, Nicaragua, Niger, Nigeria, North Korea, Oman, Pakistan, Palestine, Panama, Philippines, Qatar, Republic of the Congo, Russia, Rwanda, Saudi Arabia, Senegal, Sierra Leone, Slovakia, Somalia, South Sudan, Sri Lanka, Sudan, Suriname, Syria, Tanzania, the Balkans, Trinidad and Tobago, Tunisia, Uganda, United Arab Emirates, Vanuatu, Venezuela, Yemen, Zambia and Zimbabwe.
Users located in, ordinarily resident in, or attempting to access the Service from a Restricted Jurisdiction must not register, access, purchase Credits, or use paid Services. We may also restrict accounts or transactions where required by applicable sanctions, payment-network rules, legal requirements, fraud controls, or risk-management obligations.
Attempts to circumvent geographic, payment, or access restrictions through VPNs, proxies, false address information, third-party payment instruments, or other means are prohibited. The list of Restricted Jurisdictions may be updated where reasonably necessary to reflect legal, regulatory, payment, security, or operational requirements.
Profile Visibility and Review
All user profiles are subject to manual review and verification by our moderation team. We may review profile information, photographs, and other submitted content before or after a profile becomes visible on the Platform to help ensure compliance with these Terms, our Community Standards, and applicable safety requirements. If any aspect of a profile violates our policies, the moderation team may restrict, hide, request changes to, or remove the relevant content or profile.
Manual profile review is intended to reduce misuse, impersonation, fraudulent activity, and policy violations. Review times may vary from a few minutes to several hours depending on volume and the nature of the content. While a profile is under review, it may not appear in search results and certain features may be limited.
Profile Requirements
To foster a respectful and secure environment, your profile must:
Display accurate information and must not impersonate another person.
Avoid offensive language or the unauthorized use of another person’s name.
Exclude images containing nudity, pornography, or otherwise prohibited content.
Communication Preferences
Email Notifications: By providing your email, you agree to receive service-related communications. Where permitted by applicable law and based on the required consent or other lawful basis, we may also send promotional emails. Marketing emails will include an unsubscribe mechanism.
PROFILE VERIFICATION
Account access requires email verification, and user profiles are also subject to manual profile verification by our moderation team. Manual profile verification may include review of profile information, photographs, submitted media, and other information made available through the profile for consistency with our Terms, Community Standards, and safety requirements.
Manual profile verification is a risk-reduction and moderation measure and does not constitute a guarantee of a user’s legal identity, background, intentions, honesty, location, compatibility, or suitability. Where reasonably necessary for fraud prevention, payment security, account recovery, safety investigations, legal compliance, or other legitimate risk-control purposes, we may request enhanced verification, which may include a selfie, government-issued identification document, or limited evidence relating to the payment method used, with sensitive payment-card details concealed. Failure to complete a reasonably requested enhanced verification may result in temporary restriction or termination of the account.
The Website is strictly for personal, non-commercial use. Soliciting, advertising, or using the Website to promote services without explicit consent is prohibited.
Third-Party Restrictions
This Agreement is solely between you and the Website. No third party can inherit your rights or obligations under these Terms except as permitted by applicable law. The Website reserves the right to transfer its rights and responsibilities as needed.
One Account Policy
You are allowed only one account. Creating duplicate accounts is not permitted.
Public Content Disclosure
Any information you choose to share publicly on the Website may be visible to other users.
Security Advisory
Exercise caution when sharing personal details. While we strive to maintain a safe environment, we cannot guarantee the security of interactions with other users.
If you encounter harassment, fraud, abuse, or misuse of your data, report it to the appropriate authorities and inform us via email.
Account Protection
You are responsible for maintaining the security of your login credentials and any actions taken under your account. If you suspect unauthorized access, notify us immediately.
We are not responsible for losses resulting from compromised account details except where liability cannot lawfully be excluded.

Private messages may not be routinely monitored except where permitted or required by applicable law, for security, fraud prevention, moderation, or investigation purposes.

Use of the Website and its services is at your own risk. While we aim to maintain a safe platform, we cannot guarantee that all users will adhere to these Terms.

4. PAID SERVICES AND CREDITS
Overview of Paid Services
While basic features such as registration, viewing profiles, and sending “likes” or “winks” are free, the Website offers additional paid services, including:
Chatting with other users;
Sending emails through the Website’s messaging system;
Sharing photos, videos, audio messages, and stickers.
To use these paid services, you must purchase the Website’s virtual currency, referred to as “Credits.”
Credit Usage for Paid Services
Each time you utilize a paid service, the corresponding amount of Credits will be deducted from your account.
The Website offers two types of paid services:
Action-Based Services: You are charged each time you perform a specific action (e.g., sending an email).
Time-Based Services: Charges are based on the duration of a service (e.g., chat fees calculated per minute).
The Website reserves the right to modify the pricing of its paid services at any time. This includes the possibility of previously free features becoming paid or vice versa.
Pricing for Paid Services
The fees for certain services are as follows:
Chatting: 2 Credits per minute;
Sending stickers in chat: 5 Credits;
Sending or receiving photos in chat: 10 Credits;
Sending or receiving audio messages in chat: 10 Credits;
Sending or receiving video messages in chat: 50 Credits;
First message to a user: 10 Credits;
Subsequent messages to a user: 30 Credits.
Additional paid services may be introduced, and this section will apply unless otherwise specified on the individual service pages. The pricing displayed on those pages will take precedence over the prices listed here.
Users should carefully review the pricing details before using any paid service.
Price Changes
The Website has the right to adjust prices for its paid services, subject to applicable law. We recommend users regularly check for pricing updates.
Free Credits
Occasionally, the Website may add free Credits to your account. These Credits are non-refundable and are for your use within the Website only.
Credits are purchased with real currency but do not hold real-world value. They cannot be exchanged for cash or used outside of the Website.
Terms such as “buy,” “purchase,” or “sell” are used for convenience but do not imply that Credits have monetary value. Credits are exclusively for use on the Website and cannot be redeemed for anything else.
License to Use Credits
Credits are provided under a limited, revocable, non-transferable, and non-exclusive license for use solely on the Website.
You cannot transfer, resell, or exchange Credits, and you do not own or have any property rights to them, except for any rights that cannot lawfully be excluded.
In the event of account termination, except where otherwise required by applicable law, or if the Website discontinues its services, any unused Credits may be forfeited, subject to the Pricing & Refund Policy and applicable law.
Management of Credits and Liability
The Website is not liable for any loss, theft, or unauthorized use of Credits or the services obtained with Credits, except where such liability cannot lawfully be excluded.
The Website reserves the right to:
Limit the amount of Credits;
Deny the provision of Credits at its discretion;
Modify, cancel, or restrict Credits or their availability, subject to applicable law.
If Credits are lost due to technical or operational issues, they will be replenished after verification. Where appropriate, the Website may provide replacement Credits or another remedy required by applicable law.
5. PAYMENT TERMS AND CONDITIONS
To purchase Credits, you must provide the required information for order processing, including your credit/debit card details, cardholder name, and, if necessary, your billing address.
Accepted Payment Methods
Credits are purchased using real currency. Available payment options vary based on your location but may include credit/debit cards, Google Pay, Apple Pay, and other payment systems.
You can select the desired amount of Credits by choosing from available packages. The price and corresponding number of Credits will be displayed during the payment process.
Third-Party Processors
We collaborate with one or more third-party payment processors to handle transactions. The processor, acquiring bank, available payment method, descriptor, and checkout flow may vary by location and may change over time. Any processor-specific terms presented at checkout form part of the applicable payment arrangement.
We do not directly process or store full payment card information where the transaction is handled by a third-party payment processor.
If a payment fails, the system may automatically attempt to reprocess the transaction where permitted.
Currency and Associated Charges
Credits are typically priced in US dollars; however, the amount may be charged in a different currency based on your location or other factors.
By providing payment details, you authorize us and our payment processors to process the information necessary to complete the transaction.
Additional charges such as foreign exchange fees may be imposed by your card issuer, and we are not responsible for such charges imposed by your financial institution.
Regional Limitations

Additional payment restrictions may apply where required by sanctions, law, card-network rules, payment-provider requirements, fraud controls, or risk-management obligations.
By providing payment details, you confirm that you are legally authorized to use the chosen payment method and that all information you have provided is accurate, complete, and up-to-date.
Authorization to Charge
By placing an order for Credits, you authorize us or our payment processors to charge the indicated amount to your selected payment method.
Prices on the Website may change, subject to applicable law.
